The cancer victim, Vincent Reyes, 46, had quit smoking five years before he learned he had lung cancer in 2000. He claimed that he had been enticed to smoke Philip Morris starting at 14 “through a barrage of television advertisements.”
The appellate court’s Seventh Division denied for lack of merit the appeal of Philip Morris on its earlier decision that sought the dismissal of the complaint for damages filed by Reyes. (pi)
