The U.S. Food and Drug Administration (FDA) has ordered shipments of the disposable vapes sent to the US from China and Korea to be detained by its import inspectors, reports Vaping 360.

Elf Bar and Esco Bar products have been added to the “import red list” which means they can be detained at US ports on the assumption that they are unauthorized tobacco products without being physically examined. Shippers or manufacturers must prove that the products contained are legal to have them removed from the list and released.
Six specific Chinese shippers, one from the Republic of Korea and one with an US address are named as shippers of Elf Bar products in the alert, according to Vaping 360.
Under the “Notes” section for each Elf Bar shipper, the FDA says its Center for Tobacco Products (CTP) “has determined that this firm may be importing/manufacturing/shipping a new tobacco product (Elf Bar/Elfbar or EBDESIGN) without marketing authorization. Tobacco products that lack the premarket authorization requirements are considered adulterated.”
“Divisions may detain, without physical examination, the tobacco products identified on the Red List of this Import Alert,” says the FDA alert. “If the division is not sure whether a tobacco product is the same product as one identified on the Red List, the division should consult with the Center for Tobacco Products (CTP). CTP concurrence is required to add a product to the Red List.”
