EU looks at snus again

The European Commission has established a panel of experts to investigate the possible health risks and benefits associated with the use of snus, a smokeless tobacco product that is banned across most European Union nations except Sweden, and that the panel is expected to report its findings by the end of 2006.

Less than two years ago, the European Court of Justice ruled that the prohibition on the marketing of tobacco products for oral use is valid after Swedish Match, a manufacturer of a tobacco product for oral use based in Sweden, filed a legal complaint against the prohibition to market snus across the EU on the grounds of freedom to pursue a trade or profession and the right to property. The Court upheld the ban by stating that the existence of obstacles in the internal market in those products authorised the Community legislator to intervene and such a prohibition was not disproportionate to the objective of health protection.
