Three e-cigarette companies received warning letters from the Food and Drug Administration Center for Tobacco Products for allegedly stating the FDA approved, registered or tested their products, the agency said.
FDA cited its authority to regulate products “made or derived from tobacco” as grounds for the warnings, adding “these violations are specific to the FDA-related claims being made, and are unrelated to the FDA’s proposal to regulate these products under its tobacco product authorities.” It was the first time warning letters were sent to e-cigarette or e-liquid companies, FDA said.
Last year the agency issued a “deeming rule” under which it proposed adding e-cigarettes to the list of tobacco products it regulates. A final rule has not been issued.
Letters were sent to Vaperz Ltd, Knoxville Vapor and Dr. K concerning claims posted on company websites, FDA said.
