Fortune Tobacco has obtained a court order that stops the Health department from requiring cigarette companies to place graphic health warnings on their products’ packages, reports the Manila Standard Today.
Marikina trial court issued on 1 July a preliminary injunction suspending the Department of Health adminsitrative order No. 13 which requires graphic warnings on tobacco packs and labeling. The order, issued 24 May, also prohibited the use of descriptors in cigarette products such as "light" and "mild".
Fortune Tobacco, one of the two major local tobacco companies, has challenged the order on 3 June asking for declaratory relief with the issuance of a temporary restraining order and/or preliminary injunction against the directive.
In granting the petition, Judge Felix P Reyes required Fortune Tobacco to post a bond of PHP 5 million (EUR 100,000). (pi)
