Kessler seeks input on delaying ad order

US District Court Judge Gladys Kessler may delay a court order that would require American tobacco companies pay for advertising on the dangers of smoking, according to the Associated Press.

Kessler ordered the Justice Department and major US tobacco companies to provide input on whether a delay is advisable in light of recent litigation. The form the advertising was to take was not outlined in the original order issued in 2006, as part of a case filed 12 years ago.
Issues include whether tobacco companies properly warned the public of the addictive qualities of nicotine and whether the health dangers of low-tar and light cigarettes were downplayed.
New cases, including a preliminary injunction issued against the Food and Drug Administration (FDA) plans to mandate graphic warnings prompted Kessler’s request for information, the AP reported. The cases challenge the right of the FDA to impose the warnings.
Defendants in the case are Altria, owner of Philip Morris USA, Lorillard, R.J. Reynolds Tobacco and parent company Reynolds American. (pi)
