Lawmakers push for tobacco regulation

A group of lawmakers reintroduced legislation Thursday that would give the Food and Drug Administration (FDA) authority over cigarettes and other tobacco products.

The FDA legislation, which is proposed by Senators Edward Kennedy and John Cornyn, and Representatives Henry Waxman and Tom Davis, provides a framework and standards for the manufacturing and marketing of all tobacco products. Key legislative provisions include:
(1) Regulation of nicotine. The FDA would have authority to reduce nicotine yields and to reduce or eliminate harmful smoke constituents or harmful components of tobacco products;
(2) Authority for the FDA to regulate descriptors such as “lights” and “low tar”; (3) Changing the language of the current cigarette and smokeless tobacco product health warnings, enlarging their size and granting FDA authority to require new warnings in the future;
(4) Full disclosure of ingredients added to tobacco products;
(5) Authority for the FDA to require ingredient testing and to remove harmful ingredients;
(6) Authority for the FDA to do more to prevent minors from using tobacco products;
(7) Authority to establish standards for products that could potentially reduce the harm caused by tobacco products and to define the appropriate ways to communicate about these products; and
(8) A ban on the sale of candy and fruit-flavored cigarettes.
The largest cigarette manufacturing company in the US, Philip Morris, reaffirmed its longstanding support for granting the FDA authority to effectively regulate tobacco products, and urged congress to take quick action. The company believes the legislation would bring predictability and clear standards to the tobacco industry in the United States.
Previous legislative efforts to give the FDA that authority have faltered. The new bill is fundamentally the same legislation as introduced in the last Congress. Supporters believe it will fare better in the Democratic-controlled House and Senate. (pi)
