NJOY chief backs MHRA on medical e-cigs

NJOY, the e-cigarette company that won a court battle against US regulation of the product as a medical device, said it backs plans in the UK to regulate e-cigarettes as medicine.

“The FDA (US Food and Drug Administration) circa 2009 is not the MHRA (Medicines and Healthcare products Regulatory Agency) circa 2013”, NJOY Chief Executive Officer Craig Weiss said in a published letter.
“The pathway outlined by the MHRA does not rise to the level of FDA drug jurisdiction”, Weiss said in a letter to Bill Godshall, executive director of Smokefree Pennsylvania. Weiss said the MHRA will not require costly clinical testing that could push smaller companies out of the market.
MHRA, announcing plans to regulate e-cigarettes as medicines in June, said research showed nicotine levels in e-liquids did not always reflect what was on the label. The European Union is planning to regulate e-cigarettes with more than a trace of nicotine as medicines, a proposal the MHRA said it supported.
“MHRA has created an achievable hurdle that any responsible company should be able to clear”, Weiss wrote. “We certainly don’t believe that a total absence of regulation is in anyone’s interests.”
