The US Supreme Court declined a request by tobacco companies to review the constitutionality of damage suits brought under Engle progeny rules, Philip Morris USA said.

“Although we are disappointed by the decision, we will continue to challenge the constitutionality of these trials as appropriate,” said Murray Garnick, associate general counsel at Philip Morris USA's parent company Altria. “Even under the current rulings, we have demonstrated our ability to manage these cases over the last five years. Not only has a substantial number of cases been dismissed or otherwise resolved before trial, but juries have returned verdicts in favor of PM USA in approximately half of its cases tried to verdict.”
Engle progeny cases stem from a class-action suit bearing the name of deceased Florida doctor Howard Engle. The Florida Supreme Court in 2006 dismissed the suit seeking damages from tobacco companies, but allowed plaintiffs to make use of evidence findings from the class-action suit to pursue individual damage claims.
