Tobacco firms lose challenge to Louisiana ruling

The U.S. Supreme Court on Monday refused a request by tobacco companies to revoke a 2009 order requiring them to finance a USD 278 million (EUR 193.2 million) smoking cessation program in Louisiana.

The class action suit, Scott vs American Tobacco Co., filed in 1996, led to a jury verdict in 2004 that found in favour of the plaintiffs' assertion that tobacco companies misled state smokers about the addictive effects of nicotine.
Last year, Supreme Court Judge Antonin Scalia temporarily stayed a 2009 ruling by Louisiana's 4th Circuit Court of Appeal that upheld the jury verdict, ordering the tobacco companies to pay USD 241.5 million for smoking cessation programs plus another USD 37 million in accumulated interest.
In their legal brief to the Supreme Court, attorneys for Philip Morris USA Inc. and three other tobacco companies argued that the Louisiana courts had violated their clients' due process by allowing lead plaintiffs who had quit smoking. 
The other companies in the case are Brown and Williamson Holdings Inc., R.J. Reynolds Tobacco Co. and Lorillard Tobacco Co. (pi)
