Santa Fe Natural Tobacco, maker of Natural American Spirit cigarettes, may face a class-action suit for product descriptions including natural, organic, unadulterated tobacco and additive free, court documents show.
Filed on behalf of Florida resident Justin Sproule and others, the federal complaint also names Santa Fe owner Reynolds American. The lawsuit follows a warning issued in August by the Food and Drug Administration to several cigarette makers, including Santa Fe and Reynolds, to stop using the words natural and additive-free on packaging.
“The marketing for American Spirits is the most deceptive of any major US cigarette brand currently on the market,” states the complaint filed in US District Court for the Southern District of Florida by attorneys from Schlesinger Law Offices in Fort Lauderdale.
