The Supreme Court declined to hear a challenge to provisions of the 2009 Family Smoking Prevention and Tobacco Control Act on warning labels, advertising and modified risk products, court documents show.

The ruling allows the Food and Drug Administration to proceed with regulations for graphic warnings on cigarette packs, according to a statement by the Campaign for Tobacco-Free Kids.
American Snuff Company, a subsidiary of Reynolds American, had asked the court to overturn an appeals court ruling backing provisions of the act that mandate larger warnings, ban tobacco sponsorship of sporting or entertainment events, and handing out free samples. The smokeless tobacco company also asked the high court to rule on the legality of requiring companies to prove the health benefit to the federal government before obtaining approval to market a modified risk product.
