A Florida appellate court upheld a multi-million dollar Engle-case award to the daughter of a deceased smoker who used products made by RJ Reynolds Tobacco (RJRT), the Ocala Star Banner reported.
A three-judge panel of the 2nd District Court of Appeal rejected RJRT’s claim that punitive damages should be limited to three times the compensatory damage award, the Star Banner said. Jurors in Hillsborough County had awarded Cindy Evers USD 12.36 million (EUR 10.4 million) in punitive and USD 2.95 million in compensatory damages, the newspaper said. Engle cases stem from a 2006 Florida high court ruling throwing out a class-action suit bearing the name of Howard Engle but allowing individuals to use findings in that case to pursue damage claims against cigarette makers.
