EU high court strikes down TPD2 challenge

The Court of Justice for the European Union (CJEU) upheld the legality of the revised Tobacco Products Directive, striking down a challenge by Philip Morris International and British American Tobacco, the BBC reported.

The EU high court in Luxembourg ruled TPD2 “did not go beyond the limits of what is appropriate and necessary,” the broadcasting service reported. Among its provisions, the revised Directive sets a minimum for health warnings of 65 per cent of major surfaces on cigarette packaging. E-cigarettes also face regulation under TPD2.
TPD2 also allows individual countries to mandate uniform tobacco packaging, which the UK, France and Ireland have adopted. In the UK, the High Court is scheduled to rule 18 May on a plain-packaging complaint filed by the tobacco industry, the BBC said. A plain pack challenge also is before the World Trade Organisation.
“It is regrettable that the Court has decided to endorse the proliferation of different regulations for the same product across the European Union”, said Vassilis Vovos, Japan Tobacco International's regional president for Western Europe. “There are only 16 days left before TPD2 comes into force. Yet the legislation is still not transposed in the majority of member states. This leaves the industry with little clarity," he said. "The CJEU rulings bring additional confusion.”
